Based on articles 15 and 16 of the Federal Law on Protection of Personal Data Held by Individuals of the United Mexican States, we inform you that our company BLABER, Inc. (hereinafter “BLABER”), with a mailing address at 1309 Coffeen Avenue Suite 5523 Sheridan, WY 82801, USA, is the personal data controller.

The company “BLABER” collects your personal data for the use described in this “Data Protection Policy” and through this privacy policy, you are informed of the legitimate and controlled processing of personal data, to guarantee the principles of confidentiality and integrity in the use of your personal data.

Web

The website: www.blabler.app, is only an information page accessible to the domain public, and therefore does not contain information considered restricted to minors; It is only when it is intended to use the webapp, that is, the application called BLABER, on the iOS or Android platform, when minors are restricted.

Legal Age

You must have at least the legal age of majority under applicable law in your country of registration, to use the application to use the application called “BLABER”, on the iOS or Android platform. Android (hereinafter simply “Webapp” and/or “BLABER APP”).

“BLABER” will not knowingly collect Personal Information from any person who is not the legal age of majority under applicable law.

Likewise, we do not want or try to attract minors to our page and/or our application (“BLABER APP”). If you are under legal age, DO NOT use the BLABER APP or send us information. BLABER collects personal data only as visitors voluntarily provide it. either by direct declaration, and/or by accepting the “Terms of Use” that are detailed on the website www.Blaber.app and/or by using the BLABER APP.

“Data Protection Policy” does not share your personal data in terms other than those provided in this “Data Protection Policy” and the “Terms of Use” that are detailed on the page www.Blaber.app and/or with the BLABER APP, unless the visitor in question explicitly gives us their permission to do so.

“BLABER” obtains personal data in two ways:

In addition, you are informed that your personal data collected here may be used for the following purposes:

1.- Employee Applicant and/or Employees : When referring to “Employee” or “employee applicant”, it means an individual who was, is, or may be, employed by, or was, is, or may be a partner or director, of any of the various work areas of any BLABER entity , including, but not limited to, directors, managers, service personnel and any subordinate personal service provider.

  • Carry out all the actions and/or procedures and/or internal procedures of BLABER , to carry out its hiring and compliance with the labor benefits acquired by virtue of the employment relationship;
  • To contact you, notify you, give you notices, relevant and/or related to and/or derived from the contractual relationship between the parties and/or related to and/or derived from your capacity as a BLABER employee and/or as a consequence thereof ;
  • Ensure the identification of Employees and the security in the BLABER facilities ;

In this sense, your information may be shared with companies affiliated with BLABER , for the same purposes described in this “ Data Protection Policy “. The information we collect helps to strengthen the BLABER Platform and/or the BLABER APP and to verify that our Users are human and not bots. Registration information such as your sexual preference, name and username may be visible to other Users on your profile page.

Profile information

We recommend and ask you to reflect on what information you disclose and share.

IT IS STRICTLY PROHIBITED AND CONSTITUTES A VIOLATION OF THE RIGHTS OF THIRD PARTIES, WHICH MAY BE PUNISHED IN ACCORDANCE WITH THE APPLICABLE LEGAL PROVISIONS IN MEXICO, TO REVEAL ANY DATA CONSTITUTING PERSONAL DATA OF ANY THIRD PARTY, WITHOUT YOUR PRIOR WRITTEN CONSENT. In the same way, it is FORBIDDEN to publish email accounts, URLs, chat data, telephone numbers, full names with addresses, bank card data, national identity documents, driver’s license and any type of personal information, either in the user’s profile, as in any conversation with any third party within the BLABER Platform and/or in the BLABER APP, to avoid, as far as possible, the misuse and/or abuse of said information. ANY OWN INFORMATION OF THE USER AND/OR OF ANY THIRD PARTY, that you publish in your profile and/or in the chat and/or in any way in the use of any BLABER Platform and/or in the BLABER APP, will be under your own and exclusive responsibility.

When you upload and choose to share sensitive information (such as your sexuality, beliefs, and political leanings), you are explicitly consenting to sharing that information with other BLABER members.

Profile Verification Information (including biometric information)

For security purposes and to ensure you have the best possible user experience, we ask Users to verify their accounts and we may ask for your phone number and in some cases we might also ask you to verify by photo, affection to make sure that you are a human, of legal age, and not a bot, to try, as far as possible, to create fake BLABER accounts that can be used for malicious activities and cybercrime.  of

We may require this verification to avoid any type of fraud or crime.

If you choose to verify your profile photo, we will scan each photo you submit. Scanning may include the use of facial recognition technology so that we can compare the photo you submit with your profile photo, to help ensure that you are who you say you are. We do not add verification photos to your profile. We retain scans for future verification and our registration purposes until we no longer need them for such purposes or for five years after your last interaction with us, whichever comes first. After the applicable retention period has elapsed, we take commercially reasonable steps to delete scans permanently and securely from our systems.

About purchases

If you decide to purchase any of our premium services, we will process your payment information and retain it securely to prevent fraud and for purposes related to audit or tax controls.

BLABER uses automated decisions as part of its anti-fraud procedures, to prevent fraudulent payment transactions from taking place. To do this, our systems review payment transactions that may indicate a breach of our Terms of Use. If a transaction meets certain criteria that the Terms of Use may have been violated, the transaction will be automatically blocked. If a transaction is blocked, affected users will be notified that their transaction could not be processed, and they can contact BLABER to challenge the decision.

In case your account is blocked, any other account(s) you have in our other group/platforms/applications will also be blocked as part of our anti-fraud and anti-spam procedures.

From Surveys and other Contributions

From time to time we may conduct surveys for research purposes and contact you to find out if you want to participate. We may also contact you to find out if you would like to provide feedback, a testimonial or participate in marketing campaigns (for example, if you tell us that you have found a match with another user, we may contact you to ask if you would like to appear in BLABER advertising). These surveys and marketing campaigns are optional, and more information will be provided at the point of contact. If you have granted to BLABER access to your location in your device settings, when you use your mobile device, we will collect information about WiFi access points, as well as other location information about your longitude and latitude, and we may store the coordinates of your device to provide you with certain features. This information helps us identify your physical location and we use it to personalize the Application and make it easier for you to interact with other Users, by allowing general location information to be displayed to Users who view your profile and showing you the profiles of other Users. Moderation practices

We use a combination of automated systems and a team of moderators to monitor and review accounts (including photos and other information uploaded to user profiles) and messages with content indicating violations of our Terms of Use.

If an account or message meets certain criteria that demonstrates a likely violation of the Terms of Use, the corresponding account will be subject to a warning and restricted and/or blocked user access.

If you post anything that is inconsistent with this Data Protection Policy and/or our Terms and Conditions of Use, we reserve the right to terminate or restrict access to your Account.

We contract with certain trusted third parties to perform functions and provide services for us (“Service Providers”). For example, to provide our services to Users, we typically use the following providers:

  • Billing services: to allow customers to purchase payment functionalities of the BLABER Platform and/or our BLABER app (for example, Google Play)
  • Authentication services – to allow clients to authenticate your account (for example, AWS Cognito)
  • Social network providers: to allow customers to create/connect their BLABER account with their account(s) on said platforms (for example, Facebook, Instagram, or Spotify).
  • Product Improvement and Market Research: We use third-party platforms (such as Google Analytics) and agencies to conduct customer surveys and market research to improve our products and services.
  • Information technology services: some of the third-party software providers used in the operation of our business may process Users’ personal data (for example, if a User contacts us through social media with a question of aid.

We carry out due diligence on all Service Providers we engage to ensure that they have adequate data protection and information security measures in place and we only provide them with personal data that is necessary for the service they provide. Steps are taken to ensure that shared data is as non-attributable as possible and our vendors are also subject to extensive obligations under our contractual agreements, including strict data retention limits.

 

Marketing service providers

We partner with marketing service providers (such as Facebook Ads) (“Marketing Service Providers”) to help us market and advertise the BLABER Platform and/or our BLABER App and services on third-party websites and apps and measure the effectiveness of our advertising campaigns. For example:

  • to exclude you from advertising campaigns aimed at finding new users, if you already have a BLABER account;
  • BLABER advertisements to users who have visited the BLABER Platform and/or the BLABER APP, but have not yet created a BLABER account ;
  • to create an audience for our ads of other potential users who have similar characteristics to you based on the information Marketing Service Providers have about you (also known as Similar Audience); either.

*Hash is a way of encrypting information by turning it into a combination of random numbers and letters. This code cannot be traced back to the email address. When encrypted email addresses are sent to a marketing service provider, they are matched against the provider’s existing list of their own users’ encrypted information and our advertisements are displayed to those of our users who have been successfully matched against those of the provider. Matching and unmatched hashes are removed by the provider.

Personal data that other Users and non-users can freely see.

The BLABER Platform and the BLABER APP are designed to make connecting with other Users and interacting with them easier.

When using BLABER , you must consider and assume that all and any information, personal data, and any other content, that you publish or upload to the application, can be seen and publicly accessible, both by Users and by non-users of the BLABER Platform. and/or the BLABER APP.

We recommend that you be aware of what you post, what you comment on, what you upload, how you react to certain content, since all of this may become public at a certain time, including, but not limited to, religious, health, financial, sexual preferences, your location, your address, your school or employment information, among many others, which you are not obliged to provide, or fill out in the registration process, or in any BLABER form, nor thus disclose To thirds.

By making use of the BLABER Platform and/or the BLABER APP, you expressly agree to respect all intellectual property outside of you, since the violation of any intellectual property right implies the right of the author, to exercise the applicable legal actions against you, coupled with the fact that DSC, upon realizing such a situation, would proceed to cancel your BLABER account .

BLABER profile and other information that you make available through the BLABER Platform and/or the BLABER APP, including, but not limited to, certain information added to your profile through third party accounts (such as Facebook, Pinterest, Instagram, Spotify, etc;) can be seen and shared by Users with people who may or may not be users of the BLABER Platform and/or the BLABER APP. For example, a User can refer you as a partner to his friend(s) from another BLABER Platform and/or from another application, or for other purposes, by taking a screenshot of your profile photo and sharing it, regardless of whether Said friend(s) is also a User of the BLABER Platform and/or the BLABER APP.

If you log in or access the BLABER Platform and/or the BLABER APP through your account of another application or another third-party account on a device that you share with others, remember to log out of the BLABER Platform and/or the BLABER APP and the relevant third-party account when you leave the device to prevent other users from accessing your BLABER account .

Use of data from your social networks to log in to BLABER

When you log into our application with your account from other social networks and/or from another application or BLABER Platform, you give permission to said network, application and/or site to share your name and profile picture with us. Unless you opt out, you also give such network, application and/or site permission to share with us your email address (if one is associated with your account on such network, application and/or site), date of birth, profile photos, gender, page likes, and current town/city.

If you sign up or sign in with your Apple ID, you give Apple permission to share your Apple login, a name (which you can edit), and email (you can choose to hide your email and Apple will create an address random email address so that your personal email can remain private). This email address will be linked to your BLABER account and will be used to recover it.

We will then use this personal data to create your BLABER account . If you delete the BLABER APP from your settings of another network, application and/or site, or from your Apple ID, we will no longer have access to this data. However, we will still have the personal data that we received when you first set up your BLABER account with your network, application and/or site or your Apple ID (you must delete your BLABER account completely so that we no longer have access to these data).

Use of your information for the recommendation of friends and content

If you use BLABER , we can make use of information about your activity, life and interests to recommend friends and content.

Your profile

Remember that the profile you create for the use of the BLABER Platform and/or the BLABER APP could be viewed by BLABER users. Your activity and what you post could be viewed by one or more BLABER users, and/or used outside of BLABER, because of the screenshot that any of the users with whom you interact could take.

Conservation and deletion obsolete of data.

Your personal information will be deleted, unless: (i) we must store it to comply with applicable law (for example, if you make purchases within the BLABER Platform and/or the BLABER APP, some personal data may be retained for accounting purposes); (ii) we need to keep it to demonstrate our compliance with applicable law (for example, if an account is blocked, we keep some account data and a record of the behavior that led to the blocking; this information is kept for evidentiary purposes in case of legal inquiries or claims regarding the blocking); (iii) there is an outstanding problem, claim or dispute that requires us to retain the relevant information until it is resolved; or (iv) the information must be saved for our legitimate business interests, such as preventing fraud and improving the security of each Member (for example, it may be necessary to save information to prevent a user who was blocked for displaying a dangerous behavior or security incidents open a new account).

Treatment of personal data and rights

BLABER will not share, without your prior consent, your personal data with third parties, national or foreign, outside the BLABER group of companies , such as: companies affiliated with BLABER , any other company in which BLABER directly or indirectly owns more than 50% of the outstanding shares, or any other company that bears the name ” BLABER ” in its corporate name (all of them may be in Mexico or abroad), except (a) that the law or a court order so require; (b) that the information must be shared with BLABER contractors to carry out internal operations and fulfill the purposes described; (c) to protect the rights or assets of BLABER or its employees and/or applicants; (d) that said transfer is provided for in the Federal Law on Protection of Personal Data Held by Private Parties. We have required or are requiring our contractors to agree to use your personal data only for the purpose of carrying out the operations for which they were hired.

 

BLABER has adopted the security, administrative, technical, and physical measures necessary to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or treatment. However, BLABER cannot and therefore does not guarantee that there will be no unauthorized access to your personal data or that communications will be free from any interruption, error, or interception by unauthorized third parties.

Access to your personal data, in the possession of BLABER , will be limited to the people who need to have access to said information, with the purpose of carrying out the identified purposes.

In the event that at the time of providing your Personal Data to BLABER you are assigned a username and password; you will be responsible for keeping said information confidential. We suggest you not share this information with anyone. If you share your computer, always try to sign out before leaving a site or service to prevent unauthorized third parties from accessing your information.

Your personal data and the details of the treatment of the same that BLABER may have collected or obtained from the date of its constitution, have been accessible to you from the moment you provided them or the company collected them, as well as you have had access to rectify them if they are inaccurate or incomplete; cancel them when you consider that they are not required for any of the purposes indicated in this “Data Protection Policy”, they are being used for non-consensual purposes or the contractual or service relationship has ended; revoke your consent for the processing of your Personal Data at any time, in order to stop using them; or, to oppose the treatment of the same for specific purposes (jointly, the “ARCO Rights“).

BLABER may deny access (the “Refusal”) for you to exercise your rights in the following cases:

  1. When you are not the owner of the personal data, or cannot prove the representation of the owner;
  2. BLABER database .
  3. When the rights of a third party are injured.
  4. When there is a legal impediment or the resolution of a competent authority, which restricts your rights.
  5. When the rectification, cancellation or opposition has been previously made.

 

The request to exercise Access, Rectification, Cancellation and Opposition to Personal Data Rights must contain at least the following:

  • Your name, full address (Street, interior and/or exterior number, neighborhood, zip code, city and state) and email to be able to communicate the response to the Access, Rectification, Cancellation and Opposition to Personal Data, Request;
  • The documents that prove your identity (copy of INE* (personal ID), current passport, professional license or immigration document);

BLABER will respond to the request within a period not exceeding 15 business days from the date on which the corresponding request is received, through the email that has been provided for this purpose.

The exercise by the users of the rights must be subject to the applicable laws and regulations in force in Mexico.

It is made known that by providing any type of information, including your personal data, you expressly: (i) accept the conditions contained in this “Data Protection Policy”; (ii) you agree that the information provided by you can be stored, used and, in general, processed for the purposes indicated, including for commercial and promotional purposes; (iii) grants BLABER authorization to obtain, compile, store, share, communicate, transmit and use such information in any manner or form, in accordance with the conditions established herein and applicable laws.

LOGS/IP ADDRESSES OF THE INTERNET SERVER, COOKIES AND WEB BEACONS. –

To improve the experience of your BLABER users, we automatically receive certain types of information when you interact with us on the BLABER Platform and in the emails that we can send each other. The automated technologies we use may include, for example, Internet server logs/IP addresses, cookies, and web beacons.

  1. A) Internet Server Logs/IP Addresses: An IP address is a number assigned to any user’s computer whenever the user uses the Internet. All computer identification on the Internet is conducted with IP addresses, which allow computers and servers to recognize and communicate with each other. BLABER collects IP addresses to perform system administration and report aggregate information to business partners and/or vendors for site analytics and performance review of the BLABER Platform and/or BLABER APP.
  2. B) Cookies: For the purposes of this “Data Protection Policy” “cookies” means the text files of information that a website transfers to the hard drive of the user’s computer to store certain records and preferences. BLABER may use “cookies” for a better understanding of user interaction with the BLABER Platform, the BLABER APP and the services provided. The BLABER platform and the BLABER APP may allow advertising or third-party functions that send “cookies” to users’ computers. By “cookies” users are not personally identified, only their computers. Web beacons, cookies, and other tracking technologies do not automatically collect personally identifiable information about you.
